InfiniQuest Ethical Use License v1.0

Effective Date: August 11, 2025

1. License Grant and Scope

InfiniQuest is dual-licensed under:

• GNU Affero General Public License v3.0 (AGPL-3.0) for the source code
• This Ethical Use Addendum which adds additional requirements

You must comply with BOTH licenses to use InfiniQuest. Violation of either license terminates your rights to use the software.

2. Data Collection and Privacy Requirements

2.1 The Clarity Standard ("The Grandma Test")

Data collection must be so clear that no one can be tricked into agreeing without understanding. This means:

• Clear and digestible: Present consent requests in small, understandable pieces
• No trickery: No pre-checked boxes, buried terms, or deceptive wording
• Granular control: Users choose what to share, not all-or-nothing
• Active reminders: Users see indicators when data is being collected or shared
• Easy opt-out: Stop sharing must be as easy as starting

If your grandmother could be confused or tricked by it, it fails the test.

2.2 Consent Requirements

• Data collection requires explicit, informed consent
• Consent must be granular (not all-or-nothing)
• Users must be reminded when data is actively being shared
• Consent can be withdrawn at any time
• Pre-checked boxes or buried consent in Terms of Service is prohibited

2.3 User Data Ownership

• Users retain full ownership of their data
• Users MUST be able to export ALL their data in standard format
• Users MUST be able to import data from other instances
• Users can delete their data permanently
• If users choose to sell their data, they must receive the majority (>50%) of proceeds
• Data cannot be sold to third parties without explicit user consent AND profit sharing

3. Advertising and Commercial Messaging

3.1 Prohibited Advertising

• Behavioral tracking or surveillance-based advertising
• Third-party ad networks (Google Ads, Facebook Ads, etc.)
• Manipulative dark patterns or deceptive practices
• Advertisements disguised as app content
• Interruptive ads that block user tasks
• Any advertising specifically targeting children under 16

3.2 Potentially Allowed Commercial Messaging

The following may be permitted if they meet ALL criteria below:

• Contextual recommendations based on current task (not user profiling)
• Sponsor acknowledgments that don't interrupt user flow
• Community marketplace where users offer services to each other
• Ethical product suggestions that genuinely solve user problems

Required criteria for any commercial messaging:

• Clearly marked as sponsored or commercial content
• Actually helpful to user's stated goals
• Easy to dismiss or permanently disable
• No tracking or profiling of users
• No data sharing with advertisers

4. Prohibited Uses

You may NOT use InfiniQuest for:

• Surveillance or intelligence gathering on users without their explicit knowledge
• Manipulation or exploitation of vulnerable populations
• Deceptive practices including hidden fees, fake scarcity, or bait-and-switch
• Violating user privacy beyond what's explicitly consented to
• Addictive design patterns intended to maximize engagement over wellbeing
• Discrimination based on protected characteristics
• Creating vendor lock-in or preventing data portability

5. Good Faith Exemptions

The following uses are explicitly encouraged when done ethically:

• Therapists and mental health professionals helping clients
• Schools and educational institutions supporting student growth
• Rehabilitation centers aiding recovery
• Correctional facilities providing growth programs
• Non-profits serving vulnerable populations

These organizations must still comply with all privacy and consent requirements.

6. Safe Harbor for Good Faith Efforts

We recognize that ethical technology is an ongoing process, not a destination. Organizations demonstrating all of the following may request leniency:

• Proactive disclosure of potential violations before they're reported
• Immediate steps to remedy any harm caused
• Transparent communication with affected users
• Commitment to ongoing compliance improvements
• No pattern of repeated violations

This safe harbor does NOT apply to intentional exploitation, deceptive practices, or violations causing significant user harm.

7. AI Training and Machine Learning

• InfiniQuest's code may NOT be used to train commercial AI models without permission
• Academic research for public benefit may use the code for training
• Any AI trained on InfiniQuest must respect the same ethical principles

8. Enforcement and Termination

8.1 License Termination

Your license automatically terminates if:

• You violate any provision of this Ethical Use Addendum
• You violate the AGPL-3.0 license terms
• Credible evidence shows you're harming or exploiting users

We investigate all credible reports and will take appropriate action.

9. Modifications and Versions

9.1 InfiniQuest LLC's Rights

InfiniQuest LLC reserves the right to:

• Add additional restrictions to protect users from newly discovered harms
• Clarify ambiguous terms with examples and guidance
• Issue binding interpretations of these requirements
• Release new versions of this license

9.2 Version Stability

• You may continue using the version of the license you received the software under
• Within a version, restrictions can only become stricter, not looser
• Core principles of user autonomy and privacy cannot be weakened
• New versions may relax restrictions but require explicit adoption

10. Legal Framework

10.1 Definitions

• "Licensee" means any person or entity using, modifying, or distributing the Software
• "Software" means InfiniQuest and any derivatives thereof
• "Commercial Use" means use by any organization with annual revenue exceeding $250,000 USD
• "Material Breach" means violation of Sections 2 (Data Privacy), 3 (Advertising), or 4 (Prohibited Uses)
• "SHALL" indicates a mandatory requirement

10.2 Consideration

In consideration for the rights granted under this License, Licensee agrees to comply with all terms herein and in the AGPL-3.0. The mutual promises and obligations set forth constitute sufficient consideration.

10.3 Governing Law and Venue

• This License SHALL be governed by the laws of the Commonwealth of Kentucky, USA, without regard to conflict of law principles
• Any legal proceedings SHALL be brought exclusively in the courts of Madison County, Kentucky
• Licensee consents to personal jurisdiction in Kentucky for enforcement of this License

10.4 Notice and Cure Period

• Intentional exploitation or harm: Immediate termination without cure period
• Unintentional violations: 7-day cure period from written notice to remedy the breach
• Good faith efforts to comply SHALL be considered in enforcement decisions
• Notice SHALL be deemed given when sent to the email address associated with the Licensee's use of the Software

10.5 Indemnification

Licensee SHALL indemnify, defend, and hold harmless InfiniQuest LLC, its officers, directors, employees, and agents from and against any and all claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Licensee's use or misuse of the Software
• Licensee's violation of this License
• Licensee's violation of any rights of third parties
• Any harm to users resulting from Licensee's modifications or use

10.6 Warranty Disclaimer

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL INFINIQUEST LLC BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY ARISING FROM USE OF THE SOFTWARE.

10.7 Remedies

Violations of this Ethical Use License may result in:

• License termination (immediate or after cure period)
• Injunctive relief to prevent continued harm
• Actual damages where demonstrable harm occurred
• Attorneys' fees and costs in egregious cases

10.8 Assignment

Licensee may NOT assign or transfer this License without prior written consent from InfiniQuest LLC. Any attempted assignment in violation of this section SHALL be null and void.

10.9 Entire Agreement

This License, together with the AGPL-3.0, constitutes the entire agreement between the parties concerning use of the Software and supersedes all prior negotiations, agreements, and understandings.

11. Severability

If any provision of this License is held to be invalid, illegal, or unenforceable, the remaining provisions SHALL continue in full force and effect. The court SHALL interpret the invalid provision in a manner that best accomplishes the intent of protecting users from exploitation.
