Plain English Summary: InfiniQuest is open-source software (AGPL-3.0) with an ethical wrapper. By using our services or supporting our development, you agree to use InfiniQuest responsibly and understand that while we'll do our best to deliver supporter benefits, software development is unpredictable. We're building this together.

1. Agreement to Terms

By accessing or using InfiniQuest (the "App"), the infiniquest.app website (the "Site"), or supporting our development through donations, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, please don't use our services.

2. Who Can Use InfiniQuest

2.1 The InfiniQuest App

  • The app is designed for families and can be used by people of all ages
  • Children can use InfiniQuest as part of family activities
  • Parents should supervise younger children and manage family settings
  • The app is intentionally family-friendly and safe for children

2.2 Website Services (Donations & Newsletter)

  • You must be at least 16 years old to make donations or subscribe to our newsletter
  • If you are under 16, you need parental consent for these activities
  • By donating or subscribing, you represent that you meet these age requirements

3. The InfiniQuest Software

3.1 Open Source License

InfiniQuest is licensed under the GNU Affero General Public License v3.0 (AGPL-3.0). This means:

  • You can use, modify, and distribute the software freely
  • If you modify and distribute InfiniQuest, you must share your source code
  • If you run a modified version as a network service, you must provide the source code to users

3.2 Four-Part Licensing Structure

InfiniQuest uses a comprehensive four-part licensing approach. You must comply with ALL applicable parts:

1. Base License (AGPL-3.0): Core open-source license ensuring freedom

2. Ethical Requirements: User protection and anti-exploitation rules

  • Data collection must be crystal clear (pass "The Grandma Test")
  • No surveillance capitalism, tracking ads, or user exploitation
  • Users own and control their data completely
  • Must be used to help people, not harm them

3. Network & Deployment: Safety and security restrictions

  • Local/private instances encouraged
  • No public SaaS offerings (safety measure)

4. Success Contribution: Organizations over $250K/year revenue

3.3 Future Commercial Features

Some future features may require payment or subscription:

  • Cloud backup and sync services
  • Premium AI avatar features
  • Real monetary rewards systems
  • Advanced family collaboration tools

Core functionality will always remain open source and free.

4. Supporting InfiniQuest

4.1 Donations and Contributions

When you support InfiniQuest through Open Collective:

  • Your donation is a voluntary contribution to support development
  • Donations are processed by Open Collective and Stripe
  • You'll receive a receipt for tax purposes where applicable

4.2 Supporter Benefits

Important: Supporter tier benefits (early access, avatar creator, etc.) are provided on a best-effort basis. We will use commercially reasonable efforts to deliver these benefits, but software development is inherently unpredictable. We cannot guarantee specific timelines or features.

If we cannot deliver a promised benefit:

  • We'll communicate changes transparently through Open Collective updates
  • We may offer alternative benefits when possible
  • Refunds may be considered on a case-by-case basis

4.3 Refund Policy

Donations are generally non-refundable as they support ongoing development. However, we understand circumstances change:

  • Refund requests are handled through Open Collective's platform
  • We can process refunds for contributions up to 30 days after the transaction
  • To request a refund, use the "Contact" button on our Open Collective page or email [email protected]
  • Refunds are reviewed on a case-by-case basis and processed at our discretion

5. Important Disclaimers

Not Professional Advice: InfiniQuest is a personal growth and family management tool. It is NOT a substitute for professional medical, psychological, therapeutic, or financial advice. Always consult qualified professionals for serious personal, health, or financial matters.

5.1 No Warranties

InfiniQuest is provided "as is" without warranties of any kind, either express or implied, including but not limited to:

  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of information
  • Uninterrupted or error-free operation

5.2 Your Data, Your Responsibility

Since InfiniQuest is offline-first and stores data on your device:

  • You are responsible for backing up your data
  • We are not liable for data loss on your device
  • Future cloud features will have separate terms and backup policies

6. Limitation of Liability

To the maximum extent permitted by law, InfiniQuest LLC and its creator shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or use
  • Any damages exceeding the amount you've donated in the past 12 months

7. Intellectual Property

  • InfiniQuestâ„¢ is a trademark of InfiniQuest LLC
  • The InfiniQuest source code is licensed under AGPL-3.0
  • Content you create in InfiniQuest remains yours
  • We don't claim ownership of your personal data or content

8. Prohibited Uses

You agree not to:

  • Use InfiniQuest for illegal purposes
  • Attempt to hack, disable, or overburden our services
  • Impersonate others or create false identities
  • Use InfiniQuest to harm, stalk, or harass others
  • Violate the privacy or rights of other users

9. International Use

InfiniQuest is operated from the United States. We make no claims that InfiniQuest is appropriate or available for use in other locations. If you access InfiniQuest from other locations, you do so at your own risk and are responsible for compliance with local laws.

We cannot accept donations from countries subject to U.S. economic sanctions. Open Collective and Stripe automatically enforce these restrictions.

10. Dispute Resolution

  • Payment and refund disputes are handled through Open Collective's platform

  • These Terms are governed by the laws of Kentucky, USA
  • Any legal proceedings shall be brought in Richmond, Kentucky

11. Changes to Terms

We may revise these Terms from time to time. We'll notify you of material changes via:

  • Email (if you're a newsletter subscriber or supporter)
  • Prominent notice on our website
  • Updates in the app (for future versions)

Continued use after changes constitutes acceptance of new terms.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
